Decision on German ratification of the Unified Patent Court not before 2022
As will be recalled, following a request of the Federal Constitutional Court in Karslruhe, Federal President, Frank-Walter Steinmeier, waits with execution of the ratification bill of the Unified Patent Court Agreement (UPCA).
Whereas it has been tried, in the guise of democracy, to urge the court for a quick decision, democracy will, indeed, be better served with a wise decision.
However, as the court’s annual preview for 2021 does not list the two complaints against the ratification bill, 2 BvR 2216/20 and 2 BvR 2217/20, the decision cannot be expected in 2021.
Thus, the Unified Patent Court will not start off in 2021.
