Unified Patent Court Immunities and Privileges Order 2018
Following the UK Privy Council’s approval of the Unified Patent Court (Immunities and Privileges) Order 2018, the UK is now in a position to ratify the Unified Patent Court Agreement and the Protocol on Privileges and Immunities.
To do this, the UK Intellectual Property Office (ULIPO) will need to request the UK Foreign Secretary, Boris Johnson MP, to issue a letter to be deposited with the EU Council’s General Secretariat.
German ratification of the Unified Patent Court Agreement remains pending while a constitutional complaint is addressed. The unitary patent and Unified Patent Court cannot come into effect without German ratification.
